Welcome to Second Half OS™ (“SH-OS,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of the SH-OS website, web application, and related services (collectively, the “Service”). By creating an account or using the Service you agree to these Terms.
1. Eligibility
You must be at least 18 years old to create an account. The Service is designed for adults navigating the second half of life and is not directed at children under 13 (per the U.S. Children’s Online Privacy Protection Act). By signing up you represent and warrant that you are 18 or older.
2. Accounts
You are responsible for keeping your password secure and for all activity on your account. Notify us at support@secondhalfos.com immediately if you suspect unauthorized access.
3. Subscriptions, billing, and trials
SH-OS is offered on monthly subscriptions: Starter ($9), Pro ($19), and Partner ($79). New accounts include a 14-day trial. After the trial ends you must select a paid plan to retain access; we do not offer a free tier post-trial. Subscriptions renew automatically each billing cycle until cancelled. You can cancel anytime from your account settings or the Stripe customer portal; cancellation takes effect at the end of the current paid period.
4. Refunds
Our refund terms are described in our Refund Policy, which is part of these Terms.
5. Acceptable use
You agree not to:
- Use the Service to violate any law or third-party right.
- Submit content that is unlawful, defamatory, harassing, or that infringes intellectual-property rights.
- Use AI-generated outputs from SH-OS to spam, defraud, or impersonate any person.
- Attempt to interfere with the Service, including via automated scraping, denial-of-service attacks, credential stuffing, or unauthorized API access.
- Generate fraudulent referral clicks or otherwise manipulate the Creator or Partner programs.
We reserve the right to suspend or terminate accounts that violate these rules.
6. Your content
You retain ownership of the journal entries, financial notes, relationships data, and other content you submit (“Your Content”). You grant us a limited, worldwide, royalty-free licence to host, store, process, and display Your Content for the sole purpose of operating the Service for you. We will not sell Your Content. We may use de-identified, aggregated metrics to improve the Service.
7. AI features
SH-OS uses third-party AI providers (currently OpenAI and Anthropic) to generate summaries, drafts, and recommendations. AI outputs are provided as suggestions only. You are responsible for reviewing them before acting on them. SH-OS is not a substitute for medical, financial, or legal advice; consult a licensed professional for decisions in those areas.
8. Creator and Partner programs
If you participate in the Creator Program or Partner Program, those programs are governed by additional terms surfaced inside the application at the time of enrolment. Compensation, clawback, and payout rules are documented there and incorporated into these Terms by reference.
9. Intellectual property
The Service, including software, design, brand, and the “Second Half OS™” mark, is owned by us and is protected by copyright, trademark, and other laws.
10. Termination
You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms or if continued service creates risk to us or other users. After termination we will retain or delete your data per our Privacy Policy.
11. Disclaimers
THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE IS LIMITED TO THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES.
13. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws rules. You and we agree to submit to the exclusive jurisdiction of the state and federal courts located in Delaware for any dispute not subject to arbitration.
14. Changes
We may update these Terms from time to time. If we make material changes we will notify you in-app or by email at least seven days before they take effect.
